Expropriation occurs when a public authority or agency takes property for a purpose deemed to be in the public interest. In the expropriation process, a method of determining compensations and the rights of the owners and the expropriating authority are set out in the Expropriation Act.
Public projects may include the construction or expansion of roads and highways, parks, public utilities or public buildings. Private property is often acquired for public purposes by consensual agreement between the agency and the owner. However, when an agreement between the parties cannot be reached, the law may authorize the agency to expropriate the property.
